Abstract

This paper presents a comprehensive analysis of the correlation between international law norms and the legal framework of the World Trade Organization (WTO). The study aims to provide an in-depth understanding of the mechanisms available for resolving conflicts between treaties within the WTO’s legal framework and their implications for the functioning of the system. The paper evaluates the effectiveness of these mechanisms in practice and the complexities of disputes and court decisions that have shaped the current landscape of international trade. The analysis centers on two main mechanisms for resolving conflicts between treaties: the doctrine of lex specialis and the principle of systemic integration. The former is a rule of interpretation that directs courts to apply a more specific treaty provision over a more general one, while the latter seeks to interpret treaties in a way that promotes coherence and consistency across the legal system. The paper concludes that the resolution of conflicts between treaties is crucial for the stability and predictability of the international trading system. The analysis presented in this paper is relevant for scholars, policymakers, and practitioners working in the field of international trade and commerce. It offers valuable insights into the challenges and opportunities associated with the intersection of international law and the legal framework of the WTO, and provides a basis for further research in this area.
