Abstract

Interesants un saturīgs ir tiesību zinātņu speciālistu Riharda Garā un Jāņa Graša raksts par pašaizsardzības pierādīšanas problēmām starptautiskajās publiskajās tiesībās. Pierādījumu uzrādīšana Starptautiskajai tiesai ir noteikta ANO Starptautiskās tiesas Statūtu 48.–52. pantā, un problēmas rada tas, ka nepastāv metožu saraksts vai norādījumi uz pierādījuma vērtību. Lai arī formālas pierādījumu hierarhijas nav, tomēr parasti starptautiskā tiesa dod priekšroku dokumentiem, nevis mutvārdu paziņojumiem. The article of law science specialists Rihards Garais and Jānis Grasis on problems of self-defence evidence in international public courts will prove compelling and purposeful. Demonstration of evidence to International Court of Justice has been defined in Articles 48–52 of the UNO Regulations to the International Court of Justice, but the problems are caused since no methodology or indications on the value of evidence exist. Despite non-existent formal hierarchy of evidence, international courts favour written documents to oral statements.
