Abstract

Analizējot Krimināllikuma grozījumus un modelējot likuma jaunrades ietekmes scenārijus, autors atklāj savu redzējumu par kriminālsodu politikas attīstību, kurā dominē digitālās tehnoloģijas. Autors rakstā aktualizē tiesu un likumdošanas varas savstarpējo mijiedarbību kriminālsodu politikas attīstībā, norādot, ka vērojama tendence likumos iekļaut tik detalizētas tiesu spriešanas instrukcijas, ka tiesu spriešana faktiski kļūst par mehānisku darbību.The study includes analysis of the aim of the Criminal Law. Thus, the article reflects the vision and realia of criminal sentences in relation to amendments to the Criminal Law, which came into effect on 1 April 2013. The author concludes that the amendment of the sanctions provided in the Criminal Law, based on the fact that there are too many people in prisons in Latvia, is incorrect.
