The European Sport Model and Lex Sportiva: Allies or Independents in Sports Governance?

Abstract

This study, conducted as part of the research project 'Building a legal framework for European sport: the intersection of sports governance and the lex sportiva', demonstrates intermediate results regarding the interaction between the European model of sport and the lex sportiva, analyzing how these structures shape the legal landscape of sport in Europe. The study highlights key milestones in the evolution of sports law within the EU, including landmark cases such as Walrave and Koch and Diarra, which underscore the balance between market-driven regulations and self-governance in sports. The European Sport Model emphasizes principles like openness, solidarity, and a pyramid structure that supports ethical conduct and competition. However, it faces challenges from commercialization and competition with profit-driven models prevalent in North America. Our analysis reveals that good governance principles are essential for fostering transparency, accountability, and athlete protection across member states. By exploring the convergence of EU law and lex sportiva, we illustrate how this dual legal framework facilitates a cohesive approach to sports governance while addressing the unique cultural identity of European sport. This research contributes to understanding the complexities of sports regulation in Europe and advocates for continued collaboration among stakeholders to adapt to emerging challenges and maintain a fair sporting environment.
